communalismBy: Ganesh | Tuesday , 31 Mar '09 14:43:12 PM Reply | Forward For all those advocating fair trail and law of the land etc, May I ask why there must be a trail for someone caught in the act on a surveilance camera.?Inspite of that if he must be given a chance to defend himself, why didnt the election commission give Varun Gandhi a chance to defend himself citing the reason that he was caught in the act on video? and that there is no reason to believe that the CD was doctored.Is not rank communalism that we see in these acts.

Sentiments are there and every Indian wants Kasab to be hanged publicly, but law has its procedure.There is a legal provision to give chance to an accused to defend his case personally or through a lawyer. If the accused can't arrange a lawyer or any lawyer doesn't take the case of an accused the court provides a lawyer to the accused. Without completing the legal procedure of the law of the land Kasab can' t be tried. After all some one has to stand for him. It's a good thing that a lady has come forward and has shown the courage to take up the case. She may be at the target of extremists and other terrorists also. Lawyer can only plead the case, the decision will be based on the facts and evidences collected by the investigating agencies. I think an issue should not be made and the courageous lady lawyer be allowed to work.The security and safety of the lady lawyer should as well be ensured to speed up the trial.

But the Shiv Sena by playing this dirty trick has done errands for the terrorists, because India is a democratic country and not a dictatorship where a culprit could be shot to death without a proper trial, therefore, it is a must that a lawyer should be given the chance to represent Kasab.The Shiv Sena, VHP etc. are fascist organisations and they have also played a negative role. The deeds related to these organisations are blotting our Hindu Dharma. We Hindu's and our Dharma has been seen upto in the entire world until these organisations blossomed in India.

More over, even a hard core murderer who had accepted his guilt to the police may have to declare to the judges and in turn to the country as a whole. Does not the legal system permit a convict to be executed in a few days time, given food and health care until he is hanged to death. By denying Kasab the same human rights, we are denying that fundamental right. Are we afraid that he may in the court proceedings divulge disturbing information about some of our politicians who have some link to this tragedy. Far too many criminal cases in the Indian Subcontinent, the root planners and helpers happen to be politicians. If no Indian is willing to take his case, why not give an opportunity for a non-Muslim, Non-Indioan the chance to get the truth out?

The political parties themselves are violating the law by indulging in violence, knowing very well that it is a open a shut case, why dont they allow the process to be complete and finish the whole episode.If a Police Officers wife can be treated in this manner, what is the plight of the ordinary citizens. Is India also becoming a lawless state, because of a few goons and terrorists alike.

There is every possibility after Kasab's trail, Sonia Gandhi will make him secound Afzal to be used as means of her vote bank politics. It is only ineffective laws, implementation and political will power coz of which average Indian has lost faith in the system. Perhaps i feel what ever SS has done is asoluately correct.
