Allahabad, Mar 10: The Allahabad High Court today upheld the ban imposed by the state government on sale of lottery tickets of Nagaland and of other states in Uttar Pradesh.A division bench, comprising Justices M Katju and S L Saraf, held that in view of the ban order of October 29, 1997 no Nagaland state lotteries or lotteries of other state governments shall be sold in Uttar Pradesh.
While dismissing the writ petition, filed by Maavaishnav Lotteries Agency challenging the ban order on sale of lotteries, and other petitions pending before the court for the same relief, the court held that after the commencement of the Central legislation in ``lotteries (regulation) ordinance 1997 the state government is entitled to ban the state organised lotteries.''
Thus in light of the ban imposed by the Uttar Pradesh government by notification dated 29.10.1997 no state organised lotteries can now be sold in violation of the state ban which is under a Central legislation.
