May 27: The Industrial Court in Thane has temporarily stayed the closure of the ACC Machinery Company Limited, a subsidiary engineering unit of the ACC cement group.The court has stated that closure of the unit and termination of its employees will be subject to the outcome of the interim relief application. The matter will now be heard on July 10. The employees' union has urged the court to revoke the notice of closure served upon them by the company. However, the judge observed that the notice could not be revoked at this stage. But the judge stayed the closure ``in order to protect the interests of the parties, and in case it is found that the closure is illegal''.
As per the ULP (Unfair Labour Practice) complaint filed by the 90-odd employees, the ACC Machinery Company Limited is not a separate and independent unit, but a wholly-owned subsidiary. The workers claim that the unit is in good financial health. However, the management, in a notice dated March 25, declared their unilateral intention toclose down the unit from May 25. The union members were not taken into confidence, the complaint stated.
