HC directive over perks to judges

 
CHANDIGARH, May 27: A full Bench of the Punjab and Haryana High Court comprising Justice Amarjit Chaudhry, Justice S.C. Malte and Justice T.H.B. Chalapati while considering the matter of facilities available to the High Court judges in various states, directed the registrar to place the matter before the Hon'ble Chief Justice for withdrawal thereof so that these could be forwarded to the Supreme Court for issuance of effective and authoritative directions to be adopted by the Union of India and also all the states.

The matter was considered fit to be referred to the Supreme Court as it would involve the judges of the Punjab and Haryana High Court also, besides affecting High Court judges all over the country. The court had, while deciding the matter of a retired Chief Justice of the court with regard to grant of house rent allowance, noticed that despite the policy of transfer of judges from one state to the other, there was no uniformity of conditions and facilities of service and all matters like budgetary allowance, sanction and credit of leave, medical reimbursement and conveyance etc were governed by instructions issued by respective state governments.

The branch observed that conditions of service and facilities to be provided to judges of High Courts throughout India should be uniform and there should not be any variation from one state to another, particularly when the policy of transfer has come to stay. Thus, it was deemed appropriate to refer the matter to the Supreme Court for appropriate orders and directions.
