Plea against Shiv Sena chief dismissed

NAGPUR, JUNE 21: Activist Seema Sakhare's writ petition seeking prosecution of Shiv Sena Chief Bal Thackeray for his alleged derogatory remarks against Congress president Sonia Gandhi and ``women in general'' was dismissed here on Saturday by the High Court Bench at Nagpur.

Justices M B Ghodeswar and S S Nijjar, comprising the division bench which presided over the hearing before admission, have reserved the reasons for dismissal of the petition till further notice.

Sakhare had alleged that the Sena chief addressing a public rally at Katol near here on February 7 as part of the Lok Sabha polls campaign made derogatory references to the Congress president as well as the women in general. She had stated the remarks were not only derogatory to women as a class but also cause insult and injury to their dignity. She pointed out that meeting had caused a major outcry with various social organisations criticising the Sena chief for his remarks.

She had further stated the remarks were tantamount of causingpsychological violence against women. Representing the Sena chief, senior counsel and former Advocate General V R Manohar maintained that Thackeray's utterances were part of a normal political speech not aimed at the women as a class nor did the Sena chief made any derogatory reference to Sonia Gandhi.

The senior counsel submitted that the writ was based upon media reports of which judicial cognisance can not be taken. Besides, Sakhare ought to have moved the magistrate concerned, as per provisions under Sections 190 and 200 of the Code of Criminal Procedure.
