CHANDIGARH, JULY 24: As the High Court directives come into effect from tomorrow, some of its provisions might not be implemented, at least for the time being.According to the UT IGP, R.P. Singh, certain provisions would not be implemented with immediate effect, for want of action by other departments.
Challaning motorists for not following the one-way system of plying vehicles in parts of Sectors 17 and 24, will not begin tomorrow, he said. "Till the time signboards indicating the flow of one-way traffic are put up, there will be no challaning. Besides, challaning can begin on the proposed no-overtaking zone only after signboards are installed," he added.
For areas around schools, makeshift arrangements have been made by the police before the Administration installs signboards.
Also, though the Motor Vehicle Act provides for challaning persons using helmets not approved by the Bureau of Indian Standards (ISI), the police may overlook this aspect for the time being, the IGP said.
The guidelines concerning challaning three-wheelers for various offences, which include plying with faulty fare meters, plying without fare meter, overloading, overcharging and refusal to carry passengers, are also not being followed with immediate effect. "We will begin these challans in the second phase," Singh said.
Also, there is confusion with regard to certain directions. For instance, since the High Court guidelines do not specify whether there should be a minimum age-limit for pillion-riders to be challaned, "we will concentrate on adults in the first phase", the IGP said. Another area of contention is playing music inside vehicles. While the police have been directed to challan vehicles "playing music at high pitch", there is no fixed criterion for what is the allowed pitch. "Roughly, it should not disturb others," Singh added.
