MUMBAI, August 5: Thane police commissioner Bhujangrao Mohite today said the police would appeal against the Bombay High Court order granting temporary bail to Shiv Sena corporator from Ulhasnagar, Kishore Keswani, who was arrested in the chemical theft case.The cops have charged Keswani of securing bail on false grounds after misleading the High Court.
Keswani was nabbed last Friday after the crime branch of Thane police raided a tempo carrying chemicals worth Rs 2,67,500. The case was later transferred to Central police station in Ulhasnagar, and after being produced in court, Keswani was remanded to police custody till August 3.
Police had, however, appealed that he should be kept in custody for 14 days, saying this was necessary to conduct proper investigations and verify certain documents seized from Keswani's residence which pointed to his involvement in other rackets in neighbouring states.
But Keswani moved the holiday court on Sunday evening and secured temporary bail from Justice V HBhairavia up to August 5. The judge observed in his bail order that the temporary bail had been granted in view of the opening ceremony of the petitioner's hotel at Lonavala on August 3.
However, police said Keswani had misled the HC, saying the inauguration was to be held on August 3, though the function had already taken place on Saturday, August 1. An assistant commissioner of police, preferring anonymity, said: ``We have verified from Lonavala police station that the ceremony took place on August 1. We strongly suspect the court was misled by Keswani.''
Keswani had recently bought the new hotel, Kailash Parbat, for Rs 8 crore at Lonavala, sources said. Mohite said the police is in the process of making further investigations in the matter.
Senior police officers believe Keswani must have lied to get away from the police for some time, so that he could destroy all the evidence against him.
Keswani is also the main accused in the fake warrant case in Gujarat, and many special leave petitions (SLP)against him are pending in the Supreme Court. Some sources claimed that a close relative of Bal Thackeray is taking an active interest in Keswani's case, though this couldn't be confirmed.
