MUMBAI, August 5: The Bombay High Court today dismissed a petition seeking a direction to the state government not to table the Justice B N Srikrishna Commission report on the floor of the state legislature tomorrow.The petition, filed by Bhrashtachar Nirmoolan Sanghtana, sought a stay on the release of the report up to Diwali season. Calling it a ``misconceived petition filed by those oblivious of the basic legal provisions of the Commission of Inquiry Act,'' Justice B P Saraf and A Y Sakhare turned down the plea. ``Do not rush to court as a lay citizen merely because you felt like doing so. Study the subject and see if real public interest lies in your petition,'' came the warning line.
The petitioners maintained the Srikrishna report into the December 1992-January 1993 riots will cause communal tension in the city.
Petitioners' counsel Shakuntala Joshi said the Ganpati-Diwali season will be spoilt by the possibility of violence. ``Common people have already suffered in the riots, why should theysuffer due to a report on riots. Press reports indicate once the report is released, the atmosphere in the city will become tense,'' Joshi added. But Justice Saraf said it was not right to pre-empt riots before reading the report. He said fear of riots is unjustified.
Moreover, it is the duty of the state government to release the report within six months of its submission, for which time expires on August 16.
Meanwhile, the Advocate General A V Sawant today appeared before Justice Saraf assuring the release of the report tomorrow in the state legislature.
