A Division Bench, comprising Justices Y K Sabharwal and K S Gupta, stated that the present plea by NGO Hum Safar, that sought court's direction to restrain the government from allotting a house to Priyanka, had become infructuous as the house had already been allotted to her.

Though Additional Solicitor General Madan Lokur pleaded with the bench to dispose of the petition, counsel for Hum Safar submitted that the NGO intended to amend the plea with the prayer that the allotment now be cancelled as there was no provision under law to allocate government accommodation to the wards of former prime ministers.

Priyanka was allotted the house after the SPG, authorised with the job of ensuring her safety, made the proposal to the CentralGovernment for a bigger house as the proposed 120-B Central Avenue house was not in consonance with the required category to provide proper security.

Subsequently, 35, Lodi Estate was allotted to her from the central pool.The SPG had also asked for Rs 4.32 lakh for renovation work in the Lodi Estate house. Though the government accepted before Parliament that Priyanka was not entitled for such a house, it clarified that she was being given the house out of serious security considerations.
