CHANDIGARH, Sept 7: A superintending engineer, besides seven others accused in the Engineering Department kickback case were granted exemption from personal appearance, till the filing of the challan, by UT Additional District and Sessions Judge S.S. Lamba today.The judicial remand of executive engineer Harsh Kumar and sub-divisional engineer Gurpreet Singh was also extended till September 19 by the Judge in the same case.At the very onset, the defence counsel moved an application stating that the challan had not been presented and no useful purpose would be served by their appearance before the court.
He added that the accused -- Superintending Engineer Jagdish Mitter, Executive Engineer N.K. Gupta, Junior Engineer J.K. Gandhi, besides former UT Chief Engineer K.K. Jerath's aide, R.P. Vashistha, peon Hira Mani and the three alleged middlemen -- will appear before the court as and when the challan is presented.
The accused were earlier arrested by the UT Vigilance Department under Section 406, 409, 420 and 120-B of the Indian Penal Code on the basis of certain diaries recovered from the residences of the alleged middlemen during raids by the income tax authorities in November last year.
While Jerath was declared a proclaimed offender in the case, the other accused, except for Harsh Kumar and Gurpreet Singh, have been released on bail.
