PATNA SEPT 18: Using his constitutional prerogatives Governor Sunder Singh Bhandari today sought a clarification from the Bihar Government on the sacking of the Jharkhand Autonomous Area Council.Acting on the complaint of the senior JMM leader and vice chairman of JAAC, Suraj Mandal, the Governor issued the show cause notice and instructed the government to comply with at the earliest.
After serving the cause to Rabri Devi government, Bhandari today left for Delhi to meet the Home Minister and Prime Minister. According to the sources close to the governor he was also carrying along with him a fresh report on the prevailing political situation in Bihar and the attempts of Laloo Prasad to push the state into a volatile situation.
Sources further maintain that Governor has been quite cut up at the wavering stand of the Central leaders which has pushed him into unnecessary controversy. The Governor has sent at least three major reports to the Centre on the existing situation in State, but there has beenonly a lukewarm response to these reports from Delhi.
According to the sources, Bhandari is angry with the attitude of the Central leaders and feels that his reports have not received due attention.
Today morning, JMM leader Suraj Mandal, who so far has been skipping away from the current political developments in Bihar, came to Patna. Fuming with anger over the betrayal by Laloo Prasad, he rushed to Raj Bhawan and handed over a memorandum to Governor.
The memorandum described the political scene as worst and pleaded for immediate invoking of the provisions of Article 356 in Bihar. Mandal apprised Governor of the political stand of his party and said there was no law and order in Bihar.
In his memorandum, he pointed out though the state government was the authority to appoint the JAAC chairman and vice chairman, the authority to dismiss the JAAC vests with the Governor. The move of the state government was completely unconstitutional.
He further mentioned that after withdrawal of the JMM support,the Rabri Devi government has been reduced to minority and as such it was not competent to take any policy decision. Suraj Mandal charged the government of indulging in illegal practices by dismissing the JAAC.
Meanwhile the entire opposition parties have decided to approach the Governor on the move of Rabri Government to bring a resolution tomorrow for withdrawing the July 22,1997 resolution authorising the Centre to create a separate Jharkhand state.
BJP leader Sushil Modi as well the JD leader Mangani Lal Mandal said that since the earlier resolution was passed by "passed unanimously, it could not withdrawn by a simple majority. Though they were confident that a Laloo Prasad would not be able to muster sufficient number, they a were apprehensive of House being thrown into pandemonium on this issue.
Senior leader Ram Jeevan Singh pointed out that there is no record in the House whether the government had taken the consent of the Speaker when it introduced the resolution last year. He pointed out thatresolution had the approval of the State Cabinet on September 12. The resolution was passed in haste when the entire opposition, barring JMM and Congress, was boycotting the House.
