Plea to HC on false police case

MUMBAI, SEPT 23: The Bombay High Court admitted a writ petition by a social activist from Malad (west) alleging that he was arrested by the Dindoshi police last month on a false case.

The petitioner, Mohan Krishnan, alleged that the case was filed at the instigation of the local MLA, Nandkumar Kale. A division bench of the court ordered the Dindoshi police and other respondents to the petition -- the DGP of the state and the police commissioner of Mumbai -- to file their affidavits.

Krishnan has alleged that he exposed the illegal business of plying private buses in Goregaon and Malad in the past, and the owner of one such service, Naresh Gidwani of Gidwani Travels is close to Kale. The MLA had inaugurated the bus service in 1996, Krishnan has alleged. He further said that a false complaint had been lodged against him by one Amit Nandloskar, who has been instigated by local interests who wanted to stop his (the petitioner's) crusading activities.

Krishnan has claimed there was threat to his life from the underworld. He has alleged that one Ramya alias Batlya has been entrusted with the job of eliminating him. The petitioner also alleged that he had crossed swords with several politicians when he took up the matter of the alleged violations in the Amir Parks project in Aarey Milk Colony.

Justice Vishnu Sahai who was sitting with Justice N Arumugham asked Krishnan's counsel, Suresh Panniker, how a case under writ of mandamus was made out. After heated arguments, the judges ordered the respondents to file affidavits. The matter is posted to September 29.
