CHENNAI, OCT 6: Leader of banned fundamentalist organisation Al Umma, SA Basha, has sent notice to the Tamil Nadu government demanding a Central Bureau of Investigation probe into the explosives seizure case ``foisted'' on him by the State police.Stating this in the petition, Basha sought to adjourn by three months, the case filed before seventh additional sessions judge Munirathinam when he was brought for extension of remand today.
The judge extended the remand of Basha and 12 others, who were present in the court, till October 20 and adjourned the case to that date.
Following the February 14 Coimbatore serial blasts, the police had raided the residence of Basha in the city and seized explosives. He was arrested along with 12 others.
In his petition, Basha said he was on conditional bail in the RSS bomb blast case and was accused of helping one of the principal offenders after the blasts. Since he was in the high risk category, he was provided with 24-hour security by the police.
With a stengun-wielding policeman, three constables and a few intelligence personnel posted at his residence, there was no possibility of bringing any explosives into his house and he had no necessity for the same, he added.
Basha said pursuant to a meeting of high officials, the State police was directed to foist a case on him to put him in prison.
The police, besides arresting him, fabricated statements as if he and other accused confessed the crime. They prepared a mahazar with false particulars stating that explosives were recovered from his residence and got a certificate from the state bomb disposal squad to the effect that the explosives were destroyed, he contended.
They also procured explosive substances from an unknown source and sent them to the forensic laboratory, he added.
Stating that the case was a false one, he said many superior police officials and civil servants in the state government were parties to the fabrication of documents.
He contended that facing trial in a fabricated casewas a great ordeal and the judgment in the case could not reveal the complicity of the officials unless investigated by the CBI.
Meanwhile, Advocate Sirajuddin, who refused to appear for Basha in the case alleging that his phone calls were being tapped by the central intelligence and his other clients were threatened not to give their cases as he was appearing for Basha, today filed a memo before the judge stating that he would appear for Basha in the case.
