Special public prosecutor M H Joshi told the court that Reeth, a student of St Joseph's College, Allahabad, had come to Mumbai after his cousin Reena Shukla studying at Bhavan's College complained in a letter that she was being constantly harrassed by her classmate Sudesh. Armed with a country-made revolver, Reeth came to Mumbai on December 4, 1996 and on the same day decided to confront Sudesh at his home at Krishnanagar, Borivli.

When Reeth went to Sudesh's home, he found the latter had gone out. Two hours later, Reeth returned and asked for Suresh. When Sureshcame out, Reeth asked him to come to the rear of the building. Sudesh's father Manjunath, smelling something fishy, followed his son to the compound, where he heard Reeth tell Sudesh ``Meri behen to chedta hai'' and then saw Reeth fire at Sudesh's forehead from point-blank range. Manjunath then screamed for help as Reeth tried to escape, and the Kamaths' neighbours chased Reeth to the market, where he threw his revolver and went to Borivli police station.

Reeth admitted that he had murdered Sudesh. Police recovered two live cartridges from him. Meanwhile, Sudesh was shifted to Harkisondas Hospital, where he succumbed to his injuries on December 10.

Non-bailable warrant against sub-inspector

One Jaikar Patil had bought a20-inch TV from Korporate Trading Syndicate, Andheri, in instalments in 1991. After making initial payment of Rs 2,490 (Rs 1,500 in cash and the rest by cheque, which later bounced), Patil was to pay Rs 1,560 per month for a period of 10 months to the firm. Till 1995, he didn't bother to pay any instalment, despite repeated reminders from Phiroz Bulsara, a partner of the firm.

In March 1995, Patil issued a cheque of Rs 20,000 drawn on Dadar Janata Sahakari Bank in favour of the firm. Bulsara deposited the cheque in his account with Bank of India, Andheri (W) branch. The cheque was dishonoured thrice, and Balsara then sent a notice to Patil to make the payment within 15 days. When no reply was given, a complaint was lodged by Bulsara with the magistrate's court on June 27, 1997. Thereafter, many non-bailable warrants were issued against Patil by the court, but he managed to get them cancelled. On September 18, 1998, a non-bailable warrant was issued against Patil by the magistrate. Bulsara took the warrantto Trombay police station and handed it to PSI Jadhav, who told a constable to accompany Bulsara to Patil's residence, where the latter was identified by Bulsara. Patil was then brought to the police station, where Jadhav told Bulsara that Patil should be given a chance and that he would be produced in court either on September 21 or 22. But Patil was neither arrested nor even produced before the magistrate.

On September 23, Bulsara filed an affidavit in which he explained what had happened at the police station. After going through the affidavit, the magistrate issued a non-bailable warrant against Jadhav.
