CP told to execute NBWs against seven policemen

NEW DELHI, October 20: Chief Metropolitan Magistrate (CMM) Prem Kumar today directed Commissioner of Police V.N. Singh to execute non-bailable warrants (NBWs) against seven policemen. The warrants had twice returned unexecuted because the Delhi police refused to co-operate with the court order.

The CMM had issued the NBWs against the policemen on September 25 for allegedly causing the death of one Jaswant Singh, torturing his family members and implicating them in a false case in December 1992. He had described the case as an ``example of police excesses''.

Making a scathing attack on Singh and the concerned DCP for not ensuring the execution of the warrants, the CMM observed: ``It is not only the image of the police which nose dives due to such inaction but it also tends to erode the faith of the common man in the courts''.

The police commissioner has to ensure that the seven are produced in court on or before October 26. The CMM's order states: ``In case the warrants are not executed, the CP shall personally appear before the court and explain the reasons thereof.'' He has also directed the Central Bureau of Investigation (CBI) to make an independent effort to arrest the accused.

The warrants were issued against Sub-Inspector Ramesh Narang, Constables Bal Kishan, Meer Singh, Rohtash Singh, Jashveer Singh, Pawan Kumar and Mohsin Khan, after the court took cognizance of a CBI chargesheet.

The Investigating Officer (IO) had returned the warrants saying that the policemen had been transferred and he did not know where they were currently posted. All the accused were earlier posted at the Samaipur Badli police station in north-west Delhi.

The CBI started investigating the case in January this year after a Delhi High Court direction. According to the CBI, the policemen had severely beaten Jaswant Singh at the instance of Udai Singh, Ved Prakash and Kishan.

The CBI said, ``The cops had severely beaten Jaswant, his brother Balbir and outraged modesty of some women members of his family and later implicated them in a false case.'' It further alleged that the policemen had inflicted injuries on themselves to show that Jaswant had attacked them.
