Judgement on KVSS reserved

Mumbai, Oct 29: A division bench of the Delhi High Court today reserved judgment in the writ petition challenging the Kar Vivad Samadhan Scheme, introduced in the Finance Act, 1998. The order is likely to be delivered next week. The scheme seeks to end cases of tax arrears embroiled in litigation by giving various sops to the taxpayer.The petitioner, the All India Federation of Tax Practitioners, had argued that the scheme is discriminatory in that it does not allow in its ambit those assessees who have paid taxes under protest while filing an appeal against the tax demand. The Petitioner has prayed for declaring the scheme void, unconstitutional and ultra vires.
