Police hauled up for ignoring court orders

NEW DELHI, January 7: A city court has pulled up officials of the Mandir Marg police station for not paying attention to its orders in a dowry death case. The court has summoned DCP (central district) T N Mohan on January 15 to present a clear picture of the investigation and receive direct instructions from it.

The case pertains to the death of 22-year-old Suman in 1996. Suman was married to Virender Tiwari on June 26, 1992. According to the police, she hung herself from a ceiling fan after being persistently harassed by her brother-in-law Ramesh Tiwari and sister-in-law Manju for dowry.

Suman's father Hosla Prasad, in his initial statement to the sub-divisional magistrate, said that he did not suspect foul play. But 17 days later he gave another statement saying that Suman had been killed by her in-laws for dowry. He told the police that he had given the earlier statement under pressure as Ramesh Tiwari had threatened to kill him. After going back to his village, Prasad reportedly also sent letters to senior police officials saying that the case's first investigating officer, Additional Sub-Inspector Dayanand Arya, had misbehaved with him.

The case was committed to the sessions court following two years of committal proceedings in the court of a metropolitan magistrate. The police are said to have nullified the initial investigation report submitted by Arya.

On December 27 last year, the court directed Mohan and the Mandir Marg police station SHO to get the CFSL report along with a doctor's opinion to complete the challan submitted.

During the hearing, the court also summoned the investigating officers of the case to explain the circumstances under which the chargesheet had been filed and why the first report had been nullified. The absence of the investigating officers and the CFSL report led the court to issue the summons. Only Arya was present in court during the hearing.

The court pronounced:``Due assistance in the matter of cognizance is not being provided by the state. The court vide its order had requested the concerned officers to spare the investigating officers but no due assistance has been provided. It appears that they have no due respect for the court order or the order has not been placed before them by the concerned authorities''.
