Lawyers meet police chief

EXPRESS NEWS SERVICE
SURAT, Jan 19: Advocates of the Surat District Bar Association (SDBA) on Tuesday evening, met city Police Commissioner Kuldip Sharma and expressed their displeasure at ``dishonesty, discrimination and criminal negligence on part of investigating police officials'' over an incident when an Ahmedabad-based DySP drove his vehicle onto a group of protesting lawyers.

Besides the arrest of H Y Chudasama, they are also demanding disciplinary action against all city police officials ``for failing to do their duty in investigating the case''.

While appreciating the police chief's assurance of an inquiry into the incident earlier, they regretted that nothing had been done. They also alleged that investigating officials had not briefed him properly on the incident.

A SDBA statement listed down the ``facts'' of the incident, when Chudasama drove his vehicle onto the lawyers, causing minor injuries to Vishnu Prasad Trivedi and another junior advocate. Pointing out that the complaint was registered in the presence of Chudasama, Umra PI and ACP (E div) and senior officials, they said even the Tata Sierra car (GJ 11 E 6500) was present at the spot.

THe advocates took strong exception to the addition of section 279 of the IPC (rash driving or riding in a public place) along with section 307 (attempt to murder) that the advocates insisted on registering the case under. ``Under section 307, there is the intention to commit crime while it is not so in the case of section 279,'' association president Ashit Mehta told Express Newsline. ``The discrimination of the investigating officials is evident as they have added the section,'' he alleged. Such a mistake can be committed by a constable, but the officers doing it showed that it was done intentionally, he alleged.

They also contended that while the police took the trousers of the two injured advocates to the FSL for examination, Chudasama was given back his car the same day, thus destroying evidence. This, they alleged, was done deliberately. They demanded that another complaint be registered against Chudasama and investigating officials of Umra be charged with disappearance of evidence.
