Maharashtra ratifies death penalty for rape accused

MUMBAI, JAN 27: The State Cabinet today ratified the Centre's proposal to award death sentences to rape accused. Talking to mediapersons after the weekly Cabinet meeting, Chief Minister Manohar Joshi said the Centre has proposed an amendment to Section 376 (i) and (ii) of the Indian Penal Code, which provides for punishment for rape.

``The Centre has proposed that the existing punishment of 10 years' imprisonment should be enhanced to the death penalty. The Cabinet unanimously agreed to the proposal,'' Joshi added.

Joshi said by and large, the accused in rape cases take advantage of the Indian Evidence Act, particularly Section 155 (iv), wherein the accused questions the character of the victim and gets acquitted. ``We have suggested to the Centre to repeal the section and ensure a deterrent punishment to the criminals,'' Joshi added.

Replying to a question, Joshi said his government had already set up 15 special courts for speedy disposal in such cases.
