NEW DELHI, FEB 9: The Supreme Court today issued notices to the Union Government, Delhi Government and others seeking an explanation on the question of surrender of land by polluting industries, which were earlier asked by the court to close and shift out of the national Capital.A division bench comprising Justice S Saghir Ahmad and Justice M Jagannadha Rao was hearing a petition filed by Birla textile mills, challenging the court's earlier orders directing it to surrender 65 per cent of the land in its possession, saying the order was contrary to statutory provisions.
The notices, returnable by two weeks, were also issued to Union Ministry of Urban Development, Delhi Development Authority (DDA), Central Pollution Control Board and Delhi Pollution Control Committee.
The bench also issued a notice to the Attorney General seeking his views on the maintainability of the writ petition, as the orders of the court were issued under Article 21 of the Constitution, which guarantees the Fundamental Right toLife.
The court, however, refused to entertain the plea of the company to modify the compensation package worked out for the workers of Birla textiles, which has relocated to Baddi in Himachal Pradesh.
