CHANDIGARH, Feb 22: Hajju and Vijendra, seeking restoration of custody of the sloth bear currently lodged at Chhatbir zoo today filed their reply to the applications earlier submitted by the zoo authorities in the court of UT JMIC Paramvir Nijjar. In the reply it was stated that the court had no jurisdiction to modify the order once passed. It was further mentioned that Vijendra was ready to give in writing that he was taking the animal at his own risk and also that he would give it a shot of the tranquiliser which would help them to transport the animal to the cage.
Stating that the authorities were simply trying to obstruct the release because the animal was fetching money for the zoo, the applicants said that when Sukhdev Singh, in-charge, animal management went to consult the zoo director, he asked the applicants to get a bigger cage and also disallowed the use of tranquiliser.
Earlier in the application, zoo authorities had also asked for payment of expenditure on the bear which came down to Rs 35.11 per day. Today in their reply, the applicants stated that the same can be procured from Chief Wildlife Warden, Divisional Forest Department, UT.
The sapurdars further requested the court to recommend to the HC to proceed against the concerned authorities under contempt of courts act. Arguments in the case will continue tomorrow.
