Adani Exports chief gets bail in customs duty evasion case

AHMEDABAD, FEB 23: Justice H R Shelat of Gujarat High Court on Monday granted bail to Rajesh Adani, executive director (finance) of Adani Export and firm's deputy general manager Harish Kumar Gupta, who were arrested by Directorate of Revenue Intelligence on charges of forging documents and evading customs duty of around Rs 1.4 crore on February 5.

The court directed Adani and Gupta to furnish a bond of Rs 50,000 each to Chief Judicial Magistrate, Bhuj. However, the court directed that Adani and Gupta will mark their presence at the Directorate of Revenue Intelligence office here every Wednesday. Besides, they will seek permission of Bhuj Chief Judicial Magistrate before leaving India, and will inform him and the Directorate of Revenue Intelligence on return, the court directed.

About alleged evasion of Rs 52 lakh customs duty in import of coal at Goa last year, the court directed that Adani Exports will give a bank guarantee of Rs 52 lakh within three days, failing which the Directorate of RevenueIntelligence can file an application for cancellation of bail. Senior advocate and Shiv Sena MP Ajit Shirodkar and advocate Ashok D Shah appeared for Adani. Earlier, Bhuj Chief Judicial Magistrate had rejected the bail application of Adani and Gupta, and had remanded them to judicial custody till February 24. The Directorate of Revenue Intelligence had submitted to the Bhuj CJM that its officials had seized 38,000 metric tonnes of coal import by Adani, valued at some Rs 7 crore, from Kandla port on February 5. Adani moved Gujarat High Court for bail on February 16.

Meanwhile, senior Central Government Standing Counsel P B Majmudar, who appeared for the Directorate of Revenue Intelligence, pointed out a recent instance of duty evasion by Adani to the Gujarat High Court on Friday during the course of hearing of bail plea. It submitted before the court that Adani Exports imported another consignment of coal from China in November-December last year and unloaded the cargo at Goa Port. The company declared that10,000 metric tons of coal of over Rs 3.50 crore CIF value was imported. It was submitted that at the time of import rate of coal was $ 90 per metric tonne, which was three times that of coal imported by the company at Kandla port in September 1998. After going through the documents and details of the consignment DRI officials found technical flaws in the import. However, the date of shipment was correctly mentioned in the papers, and a closer scrutiny revealed that Rs 52 lakh customs duty was evaded by the company, it was submitted.
