Four BMC officials' properties attached

MUMBAI, FEBRUARY 24: A City Civil court on Tuesday attached the properties of four officers of the BMC including a deputy municipal commissioner (DMC) for not complying with the court's order in a demolition case.

The officers whose properties were attached following an order by Additional Civil Judge H M Kamdi are DMC Zone III V W Joshi, Assistant Engineers H-West Ward Nitin Mendekar, M G Apte and P A Waradkar. BMC has claimed the order has been stayed by HC following an appeal.

Ramji Singh had filed a suit for injunction restraining the four officers from demolishing four rooms at a Santacruz chawl. In an order in February 1998 Civil Judge G D Parekh said a notice should be issued under Section 351 of BMC Act in case of any action against plaintiffs and due process of law should be followed in case of demolition. But BMC on March 11, '98 demolished the structures after issuing a notice under section 342. The judge observed BMC's notice amounted to contempt of court.
