NEW DELHI, March 30: The Sub-Divisional Magistrate (SDM), Chanakyapuri, Philip Thangalien Mang, allegedly threatened a lawyer at gun-point today. The incident reportedly took place at about 3:00 p.m in the Patiala Court premises. An FIR has been registered with the Tilak Marg police. According to the FIR, the complainant, lawyer R.S. Mishra, went to the SDM's office, located within the court premises, to get an affidavit attested. Although Mishra was in his lawyer's robes, the SDM refused to attest his affidavit.When the lawyer insisted that it was SDM's duty to sign an affidavit presented by a Bar Association member, the SDM reportedly got angry and asked the lawyer to get out of his office.
When Mishra protested, the SDM allegedly took out his revolver and pointed it at him. Mishra and some colleagues, who had accompanied him to the office, immediately went to the bar room to lodge a protest. When a team of lawyers came back to the office, the SDM had already left. Mishra says in his FIR:``It is impossible to believe that an officer of such a high stature could fall so low as to behave like this.''
The complaint letter has been forwarded to Ashwani Kumar (Deputy Commissioner, New Delhi), Sharda Aggarwal (Judge Incharge of Patiala House) and M.A. Khan (District and Sessions Judge). A copy of the letter has also been sent to the Commissioner of Police. Although the New Delhi Bar Association President, K.K. Sareen did not issue a statement about the incident, some lawyers have threatened to go on strike tomorrow. They have demanded immediate legal action against the SDM.
Mang, on his part, refused to comment. He only said that he had narrated the ``unfortunate'' incident to the Deputy Commissioner (New Delhi).
Deputy Commissioner Ashwani Kumar, when contacted, said that the issue will be resolved tomorrow. ``I have called the lawyer and the SDM to my office. The president of the Bar Association has also spoken to me,'' he said. He denied allegations that the SDM was drunk during the tussle. About the revolver, he said:``The SDM had bought a new revolver. At that time he was showing the revolver to his friends, who had come over.''
Some lawyers, however, including Ramesh Gupta, K.K Mannan and former Bar Association secretary Karan Singh, have said that they will be on strike tomorrow in protest against the incident.
