Swift Security Limited chairman Manmohan Chaturvedi lodged a complaint with the Vile Parle police station against Mahesh Babulal Mistry (44) and his wife Vipula (41), the accused who are sub-brokers of Swift Security Limited, charging the couple with selling bogus shares to the company. Since the amount involved was more than Rs 20 lakh, the complaint was sent to the Economic Offences (Wing) of the Crime Branch.

Swift Security Limited, a National Stock Exchange member, deals with the buying and selling of shares. The Mistrys who run a consultancy firms, Aditya Consultancy, had purchased and sold shares to Swift Security Limited between January 29, 1996 to December 20, 1997.

Initially, the police did not take any cognizance of the complaint as the Mistrys had filed a criminal writ petition in theBombay High Court. The High Court then directed Chaturvedi to go to the Magistrate Court since he had already filed a complaint in the 22nd court, Andheri. The Andheri court then directed the Vile Parle police station to proceed with investigation under Section 156 of the Code of Criminal Procedure (CrPc).

It is learnt that during investigations, Mistry filed a case in the 26th court, Borivali, against two, Laxmichand Zaveri and Viren Zaveri. Since there were two similar cases filed in two different courts, the police called Mahesh Mistry for classification and discussion. However Mistry did not oblige and instead moved the Sessions Court for anticipatory bail.After hearing both the prosecution and the defence, Principal Judge A S Aguiar rejected the bail applications.
