FSI violation, encroachment - Hotelier arrested, gets bail

PUNE, May 4: Abraham Chako Kanangara, the owner of Koregaon Park based Hotel Guruptit restaurant, was arrested last morning after the Pune Municipal Corporation (PMC) officials lodged a complaint at Bund Garden police station accusing him of violating the norms pertaining to FSI and encroachment. The hotelier was produced before the Judicial Magistrate (First Class) H C Parmar who granted him bail in the afternoon.

This is the second arrest of its kind since April 24 for alleged violation of the development control rules pertaining to FSI as per the provision of the Maharashtra Regional Town Planning (MRTP) Act.

On April 24, owner of German Bakery run by Dnyaneshwar Kharuse in Koregaon Park was arrested after the PMC officials filed a case accusing him of violating FSI norms and encroachment. He was released on bail the same day.

PMC officials have filed criminal cases against several persons involved in violating DC rules pertaining to FSI in the wake of the directives given by Municipal Commissioner Arun Bhatia that action should be taken against encroachments as per sections 43 and 52 of the MRTP Act. Shivaji Langhe, a junior engineer, had filed a criminal case at Bund Garden police station on April 24 against Kanangara relating to the development of a property at Plot number 298, Koregaon Park. In his FIR, Langhe had also stated that Kanangara started developing the property without obtaining any permission.

The decision of filing a criminal case against Kanangara was taken after a survey of the site carried out by the PMC officials on April 22 revealed the gross violation of the DC rules and norms about FIR, police said.
