Register case for impounded taxis

CHANDIGARH, May 7: On the basis of a letter to the Punjab chief minister, annexed with a writ petition, seeking the release of two taxis from the alleged custody of S.A.S. Nagar Police, the Punjab and Haryana High Court today directed Phase I Station House Officer to register a First Information Report.

Pronouncing the orders, Justice K.K. Srivastava observed: "I find that despite the best efforts of the petitioner (Bahadur Singh) for getting a case registered in respect of the two vehicles allegedly impounded by the Superintendent of Police, Mohali, district Ropar, no case was registered and the same was not investigated". Justice Srivastava further observed: "A perusal of the written statement will go to show that the stand of the respondents is that the case of the petitioner was self contradictory and therefore the respondents did not think it appropriate to register the case and probe the same".

Justice Srivastava added: "In my considered view, the stand taken by the respondents can not be said to be appropriate and correct in the eyes of the law. Section 154 CrPC specifically provides for the registration of the FIR where commission of cognizable offence has been shown to be committed by the culprits. The petitioner had approached the chief minister of the state for the redressal of his grievance in this regard, but nothing was done".

Justice Srivastava directed that the FIR "would be investigated by an officer of Deputy Superintendent of Police's rank". Justice Srivastava also directed the Additional Director General of Police (Crime) to depute "a suitable officer of the said rank to investigate the matter. These directions regarding the registration of the case be carried out by the SHO within 10 days from the date of receipt of this order." Earlier, Bahadur Singh in his petition through counsel Ranjan Lakhanpal, had sought the handing over of the two vehicles "impounded by the Mohali Superintendent of Police".
