CHANDIGARH, May 7: Rajinder Kumar, Civil Judge, Tees Hazari, Delhi, was called as a witness today in the Beant Singh case being heard by UT District and Sessions Judge B.S. Bedi.He deposed that in January 1996 he was posted as Metropolitan Magistrate, Tees Hazari, Delhi. He identified the sealed envelope shown to him and said the same had been sealed by him.
He stated that he could identify the handwriting and signature of Prem Kumar, Chief Metropolitan Magistrate (CMM), Delhi, adding that it was on the directions of the CMM that he had recorded the statements of three witnesses, namely, Gurvinder Singh, Gurpreet Singh and Tejinderpal Singh.
He stated that on January 6, 1996, he directed the witnesses to come to the courts at 3 p.m. Tejinder came first and to ensure that he was deposing voluntarily, the witness asked him certain questions. When he was satisfied that Tejinder was not deposing under force, he directed his statement to be recorded on oath. It was added that CBI DSP S.N. Saxena identified the witness and endorsed the same. The statement was then recorded and read out to the witness who signed on each page, admitting that the statement was correct.
Next, the statement of Gurpreet Singh was recorded on oath, followed by the recording of the statement of Gurvinder Singh. DSP Saxena identified these two witnesses also and endorsed the same, it was stated.
The witness added that he appended certificates to the effect that the statements were recorded in his chamber, without the presence of anyone else. On being asked about the language in which the witnesses deposed, the judge said that the statements were recorded in Hindi.
He also stated that the investigation officer was supplied with carbon copies of the statements as he had applied for the same.
