Court notice to Patel, Aloria

VADODARA, May 18: City Civil Judge (Senior Division) K A Patel on Tuesday issued notices to Municipal Commissioner G R Aloria and Deputy Municipal Commissioner H S Patel asking why their immovable and movable property should not be attached for ignoring court directives.

This follows a contempt petition for not implementing a court order against releasing sewage in an open area near housing societies in Manjalpur. The notices are returnable on June 18. The society residents filed the application for contempt of court through their lawyers Narendra Tiwari and Upendra Panchal.

Last year, the residents of Maninagar, Kirannagar, Meghana Society, Shrey Park, Kabir Complex and near by societies had sought a stay against disposal of sewage in the open as the area was becoming a breeding ground for mosquitoes and creating health problems.

Later while giving an interim stay against release of sewage, the Court had asked the VMC to a report within seven days on December 20, 1998. The VMC continued to seek time.

In Tuesday's application, Tiwari said at a time when the hearing is on, the VMC has restarted releasing sewage from April 28. He also alleged that when the residents approached the VMC authorities they were told it was not mandatory for them to follow the court order.
