NEW DELHI, MAY 26: The Delhi High Court today dismissed a petition challenging dissolution of the 12th Lok Sabha saying the Supreme Court had, in a recent order, said courts should not interfere in such matters.
The petition, filed by the Association for Social Health Action (ASHA), had challenged the dissolution on the ground that a recommendation in this regard sent to the President by the Council of Ministers was "influenced" by the President.
A division bench comprising Justices Devinder Gupta and K S Gupta, citing the Supreme Court's May 11 order on a similar plea said, "This is not a matter where the court should interfere."
"We have gone through the petition. We find the prayers similar to those raised in the petition before the Supreme Court," the bench observed.
Opposing the petition, Attorney General Soli Sorabjee said if the dissolution was considered "misconcieved", the consequent relief would be restoration of the Lok Sabha.
"But the stand of the Government is that the integrity of theinstitution of the President and Prime Minister should be protected. I am here to oppose the petition," he said.
