CHANDIGARH, MAY 31: The Sector 10 shoot-out case in which the prime accused is Harvinder Singh, nephew of Akali leader Manjit Singh Barkandi, today opened for prosecution evidence in the court of UT Additional District and Sessions Judge S.S. Lamba.In the incident that occurred in the Sector 10 market on June 8, 1998, Harvinder had allegedly opened fire on Jagtinder Singh and Manjit Singh, who were sitting in their Maruti car. The latter had died after being shot at. Following a complaint by Jagtinder, Harvinder was finally booked on June 27 under Sections 302, 307 and 34 IPC.
The prosecution produced five witnesses today including Jagtinder, who stated that on June 8, he, along with Manjit went to Sector 10 market in a Maruti car. They stopped outside Vijay Confectioners where he got out to buy a bottle of Bisleri. While they were sitting inside, two people, Harvinder (whom the witness identified in court today) and Manoj (whom the witness did not recognise) came on foot from the bank side.
Jagtinder stated that the other person exhorted Harvinder that he should not let them escape. After this, Harvinder started firing and the bullets hit Manjit on his forehead. On this, he took out his gun and fired in the air. The bullets, he stated, hit the signboard of Vijay Confectioners. The signboard was also brought to the court today. After this the witness took Manjit to PGI where he was declared dead.
Cross-examination of Jagtinder was also completed today. He stated that he had known Harvinder earlier, and that he had gone to the market to buy Bisleri bottle only.
Dr Bal Murli, junior assistant at PGIMER, today deposed that Manjit was brought to PGI on the day of the occurrence and declared dead.
Head Constable Satguru, who was present on the spot, stated that he, along with two constables, were patrolling in the area when they heard shots being fired. He stated that later he saw the two accused running away.
Cross-examination of Satguru has been deferred till tomorrow.
Superintendent, Model Jail, R.D. Sharma, stated that on June 30, he received an order regarding identification of Harvinder who was brought to jail on June 27. But, later Harvinder stated that as he had presented himself before judicial magistrate he did not want to participate in the parade.
SDM, Central, P.S. Gill, who went to the jail for this purpose also stated that the alleged accused had later refused identification.
