MUMBAI, JUNE 3: The Brihanmumbai Municipal Corporation (BMC) and the Mumbai police have given a clean chit to M M Corporation and its partners Mukund Goradia and Mohamedali Gheewala, who have filed a writ petition against sitting Shiv Sena Member of Legislative Assembly (MLA) from Vile Parle, Gurunath Desai, pending before the Bombay High Court.The petitioners, having various construction projects at Vile Parle, accused Desai of extortion and abusing his position and clout as a ruling party MLA.
Desai in turn had accused the petitioners of being associated with underworld gangs and also that they had cheated original tenants of properties which were purchased by them for development.
But police verification reports dated March 29, 1999, issued by the Deputy Commissioner of Police, attached to the Special Branch I, Criminal Investigation Department, have also certified that no case is pending against both Goradia and Gheewala.
The verification reports dated March 23, 1999, valid for six months, statethat the records checked in respect of Mukund Goradia and Mohamedali Gheewala ``shows that there is nothing adverse against them on the record of this office as far as Brihanmumbai is concerned.''
Moreover, replying to two complaints forwarded by the Juhu police station for initiation of proceedings under the Maharashtra Prevention of Dangerous Activities of Slumlords, Bootleggers and Drug-offenders Act (MPDA) against M M Corporation for alleged Floor Space Index (FSI) and MRTP violations, the Executive Engineer, Building Proposals of the BMC, has explained that no action under MPDA is necessary. The Juhu police had sought details regarding the buildings Putlibai Kapol Niwas, Hemu Castle and Hemu Villa constructed by M M Corporation for invoking the MPDA.
In his letter dated March 26, 1999, the Executive Engineer, Building Proposals, has explained that in respect of Putlibai Kapol Niwas, total TDR for regularising the work has been purchased by the developers and due sanction had been accorded to the sameby the competent authority.
The executive engineer also informed the Juhu police station not to take any action in respect of Hemu Castle owing to a writ petition pending in the Bombay High Court. He also said that no action was necessary in respect of Hemu Villa, as the plans for the building had been duly approved by his office.
The police had sought the above information from the K west ward officer and the executive engineer at the behest of complaints received from the office of the Deputy Municipal Commissioner Zone III.
