NEW DELHI, June 4: Two brothers were sentenced to life imprisonment yesterday for a murder committed 16 years ago over the ownership of a taxi stand in south Delhi. The sessions court has also sentenced an ex-Punjab police constable to two years of rigorous imprisonment for fabricating evidence to protect the convicts.Additional Sessions Judge L.D. Malik has slapped a fine of Rs 2,000 on Piara Singh and Kewal Singh. Ex-constable Resham Singh was held guilty of fabricating records in Dasuya police station to show that Piara Singh was placed under arrest on the night of April 22 that year.
The court has acquitted two other accused -- government doctor Dr Amrik Singh and a maternal uncle of the two brothers, Sarwan Singh -- on the basis of insufficient evidence. Two more accused, Gursewak Singh and Iqbal Singh, died during the trial.
On the night of April 22, 1983, the brothers had beaten up Gurdhian Singh and then stabbed him with a knife at a taxi stand in South Delhi. The fracas was a result of a feud between the victim and the accused persons' brother Kashmira Singh, who had reportedly received injuries during the fight. Piara Singh was also involved in a conflict with Gurdhian Singh over the ownership of the taxi stand. A litigation in connection with the dispute was pending in court.
The prosecution had stated that when Gurdhian Singh was declared dead on arrival in Safdarjung Hospital, Piara and Kewal escaped to Hoshiarpur, Punjab. There they reportedly approached their maternal uncle, Sarwan Singh, for help. The uncle and his brother-in-law, Iqbal Singh, allegedly in collusion with two police personnel Resham Singh and Gursewak Singh and Dr Amrik Singh, allegedly prepared false records regarding the arrest of Piara Singh in Dasuya.
The police had filed two chargesheets in connection with the case. The first chargesheet was filed against the brothers and a supplementary chargesheet against Sarwan Singh, Amrik Singh, Resham Singh and Gursewak Singh. All the accused faced trial for murder, criminal conspiracy and fabricating evidence in government records.
Resham Singh and Gursewak Singh made a false entry in the police diary and Dr Amrik Singh had prepared a false medico legal certificate (MLC), alleged the prosecution. The MLC was prepared to support the false entry into the police station diary.
The court observed: ``Resham was a party to the conspiracy in preparing a false record to show arrest of accused Piara Singh.'' However, it expressed doubt in the role of Dr Amrik Singh and held that the original document could have been either lost or destroyed.
