CHANDIGARH, Aug 12: A Mani Majra landlord has landed himself in jail for not getting the particulars of his tenant registered with the concerned police station.Kesar Singh was booked under Section 188 of the IPC last nightby the Mani Majra police. The said section provides for proceeding against "whosoever knowing that, by an order promulgated by a public servant lawfully empowered to promulgate such order, is directed to abstain from certain act or to take certain order with regard to certain property in his possession or under his management, but disobeys any such direction".
It may be recalled that on July 30, District Magistrate M. Ramsekhar, had, while passing the order under Section 144 of the Criminal Procedure Code, stated clearly: "It is ordered as an emergency measure that the residents of UT including landlords, tenants, and those running commercial establishments shall not employ any domestic servants, helpers, part time maid servants unless his/her particulars are furnished to the SHO concerned in writing.
Any breach of this order shall invite action under Section 188 of the Indian Penal Code. The order shall come into force from August 2 and shall be effective for 60 days till September 30." Here in UT this offence is non-bailable because the administration has issued a notification under Section 144 of the CrPC.
Kesar's tenant Angrej Singh has also been booked in a separate case and the two were today sent to judicial custody till August 25 by UT Judicial Magistrate (Ist Class) Naval Kumar. Meanwhile, the counsel for the landlord has filed the bail application on his behalf. The application will be taken up tomorrow.
