MUMBAI, SEPT 3: Accepting the objection of additional public prosecutor R Y Mirza that bail given to an RPI-Congress candidate from the Goregaon Assembly constituency could impede a free and fair poll, Justice Vishnu Sahai today refused to grant bail to Kashinath Muniram Pasi.Pasi had been accused of murder in 1989, wherein he was granted bail in 1991. However, he jumped the bail and was arrested again in 1997. He managed to jump bail for the second time and was declared a proclaimed offender and a non-bailable warrant was issued against him by the Dadar police station. He was then arrested by the police on August 31, 1999 and remanded to judicial custody, though he had already filled in his nomination papers on August 23.
Pasi then filed a revision application in the Bombay High Court where his counsel D N Nalavade argued that his client had not jumped bail the second time and had gone to his village in UP to attend to his ailing father. He argued that there was no fear of his client absconding furtheras he had to contest the elections.
However, Mirza argued that in all, there were 18 offences registered against Pasi, of which 3 were for murder. And 13 out of the 18 offences were from the constituency of Goregaon.
