PUNE, Sept 17: Two more accused in the ISI-spy case were granted bail on Friday afternoon as the police failed to file the charge-sheet within the stipulated 90 days as required under the Criminal Procedure Code (CrPc). This comes immediately after the co-accused David Kamlakar Manuel was granted bail on similar grounds on Thursday.In a ruling delivered by Judicial Magistrate (First Class) Pradeep Meshram, Sahebzada Badesaab Shaikh and Yeshwant Kamble were granted bail as the police failed to file the charge-sheet. Both had been arrested on June 17 and completed their 90 days on Wednesday.
They had been accused of passing sensitive information to suspected Pakistani Military Intelligence operative, Sayeed Ahmed Mohammed Desai. Recently, the case had been transferred to the Central Bureau of Investigations (CBI) after the Central Government decided to take the various cases of ISI agents caught in Mumbai, Bihar, Kanpur and Pune and club them into one composite case. The Government had decided that all the cases were part of the same conspiracy and therefore would be handled by the CBI.
According to the police, Kamble, who works with the Ordnance Depot at Dehu Road, would pass on confidential documents to Desai. Both Kamble and Shaikh had been arrested under the Official Secrets Act and remanded to police custody following which they had been placed under magisterial custody. They were granted bail on a surety of Rs 25,000 and on the condition that they would have to appear before the city crime branch everyday till further notice.
