MUMBAI, September 20: The Bombay High Court today confirmed a lower court's order convicting a sub-inspector, head constable and five other cops under the IPC for causing death of a prisoner due to alleged torture in custody a decade ago.Dilip Parmer, sub-inspector attached to Oshiwara police station was sentenced to undergo rigorous imprisonment for three years and ordered to pay a fine of Rs 3,000.
Head constable Madhukar Gawade and his colleagues Parshuram Belode, Akhtar Mohammed Jamdar, Ashok Nikam, Harishchandra Kadu and Kantilal Mandole were sentenced to two years' RI and asked to pay Rs 500 each for causing the death of one Rajiv Mohite in 1990.
The cops allegedly tortured the accused, who was in jail following his arrest on May 25, 1990. Although he was arrested in Nashik, the date specified in the FIR was May 27. Besides, the place of arrest was shown as Nehru Nagar in Oshiwara.The accused was let off after being remanded to custody for 15 days, during which he was allegedly physicallytortured. Soon after his release he was admitted to Bhagwati Hospital where he passed away after two days. Bhagwati police station had registered a case against the guilty cops who were tried by Sessions Court. The Sessions judge, Hemant Deshpande, had convicted them on March 29, 1996.
