MUMBAI, September 21: The Bombay High Court today stayed the opening and awarding of tenders for supplying food to children in anganwadis and balwadis following a petition filed by Mumbai Zilla Mahila Audyogik Sahakari Sanstha Federation Ltd. The stay will be state wide since similar petitions on the same grounds had been filed in various high court benches of Nagpur and Aurangabad. The tenders were to have been opened at 3 pm today.A division bench of Justice M B Ghodeswar and Justice S Radhakrishnan also directed that the petitions should be clubbed and placed before the Chief Justice for further directions.
The petitioners who have been supplying food to slum children under the Integrated Child Development Scheme (ICDS) for the past ten years, had filed the petition challenging the state government's decision to award a contract to the Mahila Arthik Vikas Mahamandal (MAVIM) which in turn had sent tender notices to appoint sub-contractors for the same.
Advocate for the petitioners, M P Vashichallenged the state government's tender conditions that the sub contractors' kitchen size should be 1000 sq feet claiming that this automatically spiked petitioners chances as mainly women's organisations supplied the food. However, state assistant government pleader, Abhay Patki argued that the state had not awarded any contract to MAVIM but had appointed it to oversee the scheme throughout the state.
