Cops take fizz out of Nagpada cold drinks racket

MUMBAI, SEPT 22: The Sessions court today granted anticipatory bail to an elderly man and his two sons who were charged with selling fake cold drinks of reputed companies.

According to the prosecution case, on August 16 the Nagpada police under the supervision of Senior Police Inspector S Jadhav attached to the VP Road police station raided Adam Soda Factory at Kamathipura, Nagpada. The police seized soda-making machines, gas cylinders connected to the machines, two steel drums, plastic cans and 100 bottles - Thums Up (24), Pepsi (6), Mirinda (3), Dukes (72). The bottles were topped up with fake cold drinks. The raid was conducted in the presence of two panchas and a case was registred by the Nagpada police station under Sections 272, 402, 420 of the Indian Penal Code.

In their applications for anticipatory bail, the proprietor of Adam Soda Factory Idris Ahmed and his sons have denied the allegations, adding that their shop has been closed over a long period of time.

Principal Judge A S Aguiar observedthat whether the cold drinks and soda manufactured are adulterated and noxious cannot be without the chemical analyser's report. The court also observed that even if the cold drinks are fake, it is for the concerned companies to take action.

The court also observed that in the present circumstances question of granting custodial interrogation does not arise at all. Hence the court ordered the release of Idris and his sons on a bail of Rs 5000 each in the event of future arrest by the police. The accused have been directed to report to the Nagpada police station every evening for a period of one week.

Special Public Prosecutor Vasanti Joshi appeared for the state while Sameer Rajguru appeared for the accused.
