A division bench comprising Justice G T Nanavati and Justice S N Phukan issued the notice after Chandraswami's counsel contended that as recording of most of the evidence had taken place his client be permitted to go abroad to get the much needed medical treatment.

Justice Nanavati said the notice was being issued to the CBI to ascertain the prosecuting agency's apprehensions about Chandraswami's motive for going abroad and whether he planned to return back as the case was nearing completion.

Counsel Rajinder Singh said that a medical board constituted by the court had opined that Chandraswami needs medical attention but the facilities for the same were available in India. He said his client preferred to get treated abroad in view of thecomplications.

The trial court had earlier rejected Chandraswami's plea to be permitted to go abroad. The court had already discharged former prime minister Narasimha Rao from the case leaving only the Godman and his aide K N Aggarwal alias Mamaji as accused in the case.
