CHENNAI, OCT 21: A special judge on Friday issued notice to former Tamil Nadu chief minister Jayalalitha on a petition filed by Janata Party president Subramanian Swamy to include her as an accused in the multi-crore coal import scam case from which she was discharged in June last.Judge V Radhakrishnan also ordered notice, returnable by October 29, to former AIADMK minister V R Nedunchezhian, who was also discharged from the case on June 16, and the Crime Branch-CID.
Radhakrishnan had discharged both of them on the ground that there was no evidence to show that they had seen certain observations and objections regarding the import before appending their signatures on the file relating to the deal.
In his present petition, Swamy contended that the then state finance secretary Narayanan had not approved the import and had only forwarded the `secretariat' file relating to the deal and that too with a reference to the objections raised by then Public Works Department secretary Sundaram.
The detailed noteof objections were in the accompanying `current' file on page 249, he submitted.
Stating that it would be safe to assume that Jayalalitha and Nedunchezhian had the occasion to look into the objections and that they would have been alerted even if the pages had been removed, Swamy prayed that charges be framed against them afresh and they be tried in accordance with law along with the other accused.
