Justice Anand refers TRAI case to Supreme Court

NEW DELHI, OCT 31: The Chief Justice of India, Justice A S Anand, today scheduled a hearing at his residence for a Special Leave Petition (SLP) filed by the Telecom Regulatory Authority of India (TRAI) in the SC on Saturday. Hearings at the Chief Justice's residence on a holiday are done under extreme emergency situations.

The Chief Justice, however, after hearing the case today decided that the matter did not require immediate redressal and referred the matter to be mentioned in the Supreme Court on Monday.

The reason the TRAI wanted the stay vacated on their Calling Party Pays (CPP) order which was to become effective from November 1. The SLP also mentioned that staying the order would breach their jurisdiction on matters relating to tariff.

Under the order, in-coming calls on cellphones were to become free while the callers from normal landlines would have to pay a premium rate up to four times more than the present call charges of Rs 1.20 for a three-minute call. This was stayed by the Delhi HighCourt.

, Justice S N Variava and Justice S K Mahajan, last week. It was said that the scheme was anti-consumer and would also lead to substantial loss to the public sector organisations like the MTNL (Mahanagar Telephone Nigam Ltd) and the Department of Telecommunications.
