CHENNAI, NOV 17: The Madras High Court has stayed the operation of an order of a lower court appointing an advocate-commissioner to inspect the property on which Raghavendra Kalyana Mandapam, constructed by film star Rajnikanth is standing, and to submit a report to the court.Justice S S Subramani granted the stay, while passing interim orders on a revision petition from Rajnikanth and three others challenging the lower court's order.
While passing interim orders on a civil suit from M K Manoharan, R Rajamanickam, I Assistant Judge, City Civil Court, Chennai, on October 14 had appointed advocate S N Ravikumar as the commissioner to inspect the property and to submit a report to him with plans with the assistance of a land surveyor.
In the civil suit, Manoharan prayed for a declaration that he alone was entitled to grant of patta in respect of the property. He also sought to restrain Rajnikanth and others from proceeding with the construction of the kalyana mandapam.
In their presentpetition, Rajnikanth and others contended that the issue involved in the case did not warrant appointment of a commissioner.
