Refer Lokayukta Bill back to House, says Haryana Cong

CHANDIGARH, NOV 18: The Haryana Congress today requested Governor Mahabir Prasad to refer the Lokayukta Bill, 1999, back to the state Vidhan Sabha for re-examination, alleging that the INLD government was aiming to persecute its political opponents by making the institution of Lokayukta its "pocket borough".

In a memorandum submitted to Mahabir Prasad, Haryana Congress spokesperson Randeep Surejwala said the Bill gave the impression that it was drafted to persecute political opponents of the ruling INLD-BJP combine headed by Om Prakash Chautala. "The part record of the Chief Minister itself speaks volumes about sustained persecution of his political opponents," he alleged.

Referred to Section 2(B) of the Lokayukta Bill, 1999, under which the Chief Minister has been designated as the competent authority for all public servants (barring himself), Surjewala said the law loses its very foundation as absolute powers had been vested in the Chief Minister.

"By making the Chief Minister the competent authority, the Bill displays a naked usurpation of draconian powers on part of the Chief Minister, compromising the very independence of the Lokayukta," he alleged.The party has also raised doubts about the intentions of the government in adding second provision to Section 3(1), which clearly states that consultation in appointment of Lokayukta would only have persuasive value and would not be binding on the Chief Minister. "It is apparent that sole discretion of appointing a Lokayukta is that of the Chief Minister. Such a Lokayukta would never function independently and would become a puppet in the hands of Chief Minister to be used by him," he alleged.
