CHANDIGARH, Nov 22: Disposing of an anticipatory bail application filed here in the Punjab and Haryana High Court by one of the four accused in a Rs 5.25 lakh fraud case pertaining to the sale of a plot on some society, which was not existing, Justice T. H. B Chalapathi dismissed the application, holding that the petitioner cannot take the advantage of bail granted to another accused in the same case.In the complaint to this effect, Krishna Sharma stated that the petitioner, along with three others, gave assurance to her for purchasing a plot in a certain society, which was not actually existing. The complainant added that she paid Rs 5.25 lakh towards the purchase of this plot, but it was only later that she discovered that the society and the plot so assured were not there.
The accused had convinced her that the plot was in a society named Shivalik Environ Cooperative Housing Society. It was later found out that there was no society by the said name. The Judge held that although another accused in the same case had been granted bail, the petitioner could not derive benefit of the same. The plea was thus declined.
It may be mentioned here that while the FIR was registered, under sections 406, 420, 467, 468, 471 and 120 B IPC, none of the four accused have so far been arrested. One among them has got anticipatory bail from the High Court.
