Custodial death -- Plea rejected

PUNE, Nov 24: Judicial Magistrate (First Class) V M Satpute on Wednesday rejected social worker Bhai Vivek Chavan's application demanding that the officials attached to the Khadak police station should be brought to book in connection with history-sheeter Salim Shaikh's death in their custody and that the CID sleuths should be directed to carry out a fresh inquest punchanama and post-mortem.

Salim Shaikh, who had been convicted in three previous burglaries, had died in custody of Khadak police on November 17. On November 18, Bhai Vivek Chavan had moved a miscellaneous application before the court alleging that Salim Shaikh had died due to the third degree treatment meted out to him.

The social worker had moved separate applications in the court on November 20 and November 22. The prayers mentioned in these applications included that the officials attached to the Khadak police station should be charged under sections 302 (murder) and 201 (attempting to destroy evidence) of the Indian Penal Code and that the CID sleuths should be directed to carry out a fresh inquest punchanama as well as a re-postmortem on Salim Shaikh.

While observing that the CID sleuths have already started a probe, the magistrate stated in her order that she thinks that the miscellaneous application is disposed off. The order also stated that the prayer of charging the officials attached to Khadak police station is absolutely illegal. The order added that levelling charges against any person was not within the purview of the court.

Chavan's lawyer Anthony Rananawre admitted in the court that he had no grudge or objection to the investigations carried out by the State CID sleuths.

V M Ponkshe, who appeared for the State CID sleuths, stated that investigations to ascertain whether Salim Shaikh's death was due to culpable circumstances or natural causes, were in progress and assured that the CID would bring to book the police officials if they were found guilty.
