Judge test drives BMW car to settle suit

KUALA LUMPUR, FEBRUARY 1: A Malaysian judge got into a BMW car and drove it for half an hour to settle a suit between a woman customer and the German automaker, news reports said on Tuesday.

Judge Wan Adnan Muhamad test drove the car at a speed of 110 km per hour and then ordered the woman to accept the car as he found no defects in it as claimed by her in her suit.

Businesswoman Oai Phaik Ngoh had sued Auto Bavaria, the importer of BMWs into Malaysia, in 1997, after she claimed her newly purchased 318I model kept swerving to the left.

She claimed that despite the car being checked and serviced, the steering problem persisted and she sued Auto Bavaria to replace the car with a new model, the Star daily said.

However, Penang High Court judge on Monday dismissed the suit, saying he found the car did not swerve to the left and was therefore not defective.

Both Ooi and Auto Bavaria officials had earlier agreed to accept the judge's findings as conclusive once he test drove the car.
