Mission Kashmir song rakes up controversy
NEW DELHI, SEPT 13: Filmmaker Vidhu Vinod Chopra of 1942, A Love Story fame has been accused of copyright infringment by the son of famous Kashmiri poet Dina Nath Nadim for allegedly lifting the song for his new movie Mission Kashmir from his father's famous work Bumboor Yamborzal. Asking the filmmaker to delete the song Bumbro Bumbro, which has already hit the chart just a week after the release of its music cassettes, from the movie forthwith, Nadim's son Shantiveer Kaul, in a legal notice to Chopra through his advocate Bimal Roy Lad, said on failure to do so, action for both civil and criminal liabilities would be initiated against him. While stating that he had total right under the Copyright Act over the work of his father, Kaul also claimed right in the "sale proceeds" of the music of the title song in the movie. "The music of the movie has been aired in public which includes the song of which my client has a copyright, without his knowledge or consent and the same should not have been included in your movie," the notice said adding the first two lines of it were in Kashmiri and rest had been replaced "in toto and there is similarity in the music." Kaul claimed that he came to know about the "inclusion" in the movie only after the release of the music on September 11. He said Jammu and Kashmir Government had published a commemorative volume on the work of his father under the title Shirz Nadim Number in 1989. The song Bumbro Bumbro Sham Rang Bumbro was the part of an opera - Bamboor Yamborzal - written by Nadim in 1954 and the same was staged before the then USSR president in Srinagar during his visit to the Valley, the notice said. "The poem/song has since been broadcast over All India Radio from Srinagar thousand times and is very popular among the people of the State," Kaul said addding it depicted the ethos of Kashmir, its tradition and culture. In recognition to his contribution to the Kashmiri literature, Nadim was given Soviet Land Nehru Award, Sahitya Academy Award and Kalhan Awards, Kaul said.
