Court refuses to entertain plea of 100 accused for security
MUMBAI, MAR 1: However designated Judge P D Kode directed Police Commissioner M N Singh to undertake stringent security measures in and around the area of central prison where the court is housed as the accused attend the proceedings regularly. The police chief has been directed to issue instructionsto N M Joshi marg police station to maintain strict vigil at bus stops, railway stations and strategic locations near the TADA court by deploying armed policemen and also police in plain dress. The police commissioner has been asked to take the help of other police stations to ensure security of the accused on bail and collect intelligence on alleged threats faced by them. The judge felt that his court was not competent to decide on providing security cover to the accused as it fell outside its purview and jurisdiction. Defence lawyers Farhana Shah and Subhash Kanse contended that serial blast accused faced a threat to their lives from dreaded gangster Chhota Rajan who had reportedly vowed to kill them as he disapproved of the conspiracy to cause serial blasts. CBI Prosecutor A B Belgal expressed his opposition to provide security to such a large number of accused saying the petition was vague and not maintainable. No, says the Mumbai high court which held that prima faciesuch an agreement with the society was contrary to the Flat Ownership Act and Maharashtra Cooperative Societies Act. This question was raised in a suit filed by ZoroastrainRadth Society against Pervin Nariman Jogina and her son Cyrus Nariman Jogina. The society pleaded that it was a religious charitabletrust and one of its objectives was to perform beneficial acts in the interests of Parsi Zorastrain. It has constructed several buildings at suburban Jogeshwari. One of the flats was alloted to Nariman Jogina who agreedthat his sons will not marry outside parsi community. After his death, his widow, Pervin, and son, Cyrus, also agreed that the premises will be occupied by parsi zoroastrian. However, Cyrus married a non-parsi girl, Sampada. Theaggrieved society filed a suit in the high court for taking back the flat and prayed for an injunction restraining the non-parsi wife from residing in the flat with Cyrus.
