17 years after triple murder,Sajal walks out of jail

Sajal Barui,33,convicted in the killing of his father,step-mother and step-brother in 1993,was released from Alipore Central Jail on Tuesday on bail. Barui had committed the crime when he was a boy of 16 years. The Calcutta High Court granted him bail on June 29 following his plea filed under the Juvenile Justice (Care & Protection of Children) Amendment Act,2006.
In compliance with the order passed by a Division Bench consisting of Justice S P Talukdar and Justice M K Sinha,he was released from Alipore Central jail on Tuesday,said jail Superintendent Kumaresh Roy. One relative came to receive him and was waiting outside the jail premises. Sajal left Alipore central jail with this relative,said Roy.
He added that Sajal was very intelligent and sharp. He was also an outstanding painter and exercised his hobby in jail. The jail authorities always supported him to continue his painting in jail. His works were displayed at the Birla Art Gallery and Calcutta Book Fair. One of his paintings was sold for Rs 8000,Roy added. I have seen him in the jail since 2006 and he was well behaved and introvert, said Roy. Roy was hopeful that he could start a fresh life after release from jail.
Sajal had killed his father Subal Barui,step-mother Neoti Barui and step-brother Kajal Barui at Subham Apartments,Dumdum,on November 22,1993,with the assistance of five friends. While Neoti was strangled,the father and step-brother were killed with sharp weapons.
Investigations revealed that he had killed the three to take revenge for the ill treatment of Neoti. His friends also influenced him,saying that he would become the owner of the property if he could eliminate the three.
The police arrested all the six and the Additional Sessions Judge,Barasat,convicted them. The trial court had held that the crime fell under the rarest of rare category and sentenced Sajal to death in 1995.
In 1997,Calcutta High Court set aside the death sentence and directed the trial court to conduct a fresh trial. The Additional Sessions Judge then reduced the capital punishment to life imprisonment.
However,Sajal Barui filed an appeal again in the High Court under the provisions of The Juvenile Justice (Care and Protection of Children) Amendment Act,2006,which was aimed at giving juvenile convicts a chance to rectify themselves. Advocate Sudipta Moitra argued during the hearing that Sajal was a minor when he had committed the crime and had already served 16 years in jail.
He should get a chance to start a new life,he submitted and the High Court gave the bail order.
